Placeholder language. This document is a starting draft and is not legal advice. Have an attorney familiar with EdTech, FERPA, HIPAA, and consumer-subscription law review and finalize before launch.
1. Acceptance of Terms
By creating an account or using Reportly ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. Eligible Users
The Service is intended solely for use by qualified, credentialed professionals (school psychologists, licensed psychologists, and equivalent practitioners) acting within their scope of practice. By using the Service you represent that you hold the credentials and licensure required to administer, score, and interpret the assessments referenced in your reports.
3. Nature of the Service — Documentation Aid Only
Reportly is a documentation and report-drafting aid. It is not a diagnostic instrument, scoring engine of record, or substitute for professional clinical judgment. The licensed examiner is solely responsible for:
- Selection and administration of assessments;
- Verification of all scores, conversions, and normative lookups against the publisher's official manuals;
- Final clinical interpretation, diagnosis, and recommendations;
- Review and approval of every report before it is shared, signed, or filed.
4. No Endorsement by Test Publishers
References to assessments such as WISC-V, WIAT-4, KTEA-3, BASC-3, Vineland-3, and others are nominative — used only to describe what the Service helps document. Reportly is not affiliated with, endorsed by, or sponsored by any test publisher. All trademarks are the property of their respective owners.
5. Subscriptions, Billing, and Cancellation
Paid plans renew automatically at the interval and price shown at checkout until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.
6. Acceptable Use
You agree not to: (a) upload data you are not authorized to process; (b) use the Service to provide care outside your licensure; (c) reverse engineer the Service; or (d) attempt to access another user's data.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF SCORES OR NARRATIVE TEMPLATES, OR NON-INFRINGEMENT.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, REPORTLY AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE FEES YOU PAID IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify and hold harmless Reportly from any claims arising out of your use of the Service, the content of reports you generate, or your violation of these Terms or applicable law.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use after the effective date constitutes acceptance.
